Since 1 May 2026 the Renters’ Rights Act has changed how every tenancy in England works. Assured shorthold tenancies no longer exist. A tenancy is now periodic from the first day, with no fixed term and no Section 21 notice, and tenancies signed before that date converted automatically.
What that means in practice. A tenant may end the tenancy at any time by giving two months’ notice in writing, expiring on a rent day; there is no minimum term to serve out. A landlord may recover possession only on one of the statutory grounds. No more than one month’s rent may be taken in advance once the tenancy has begun, and no rent at all may be taken before the agreement is signed. Rent may be raised once a year, and not during the first twelve months, by a Form 4A notice giving at least two months; a tenant may challenge an increase above market rent. A property must be advertised at a stated rent, and offers above it may be neither invited nor accepted. A tenant may ask to keep a pet, and consent may be refused only for a valid reason.
Before an offer is agreed you will be referenced: identity, right to rent, employment or source of income, and a previous landlord where there is one. Tenants without UK income are usually asked for a UK-based guarantor, since rent in advance is now limited to a single month.
Deposits are capped by the Tenant Fees Act 2019 at five weeks’ rent where the annual rent is below £50,000, and six weeks at or above it. A holding deposit is capped at one week’s rent. Deposits on tenancies we manage are protected with the Deposit Protection Service.
